Nest & Best is operated by NEST & BEST LTD, Company No. 16272499, registered in the United Kingdom. Throughout these Terms, “we”, “us” and “our” refer to NEST & BEST LTD.

By accessing our website or purchasing from us, you agree to be bound by these Terms of Service together with any policies expressly referred to in them, including our Shipping Policy, Returns & Refund Policy, Warranty Policy and Privacy Policy.

These Terms apply to all users of the website, including visitors and customers. These Terms do not affect your statutory consumer rights.

2. Orders & Acceptance

All orders placed through our website are subject to acceptance, product availability and successful payment authorisation.

We may refuse, limit or cancel an order where reasonably necessary, including where a product is unavailable, a material pricing or product-information error has occurred, payment cannot be authorised, or fraud or misuse is reasonably suspected.

After placing an order, you will normally receive an order acknowledgement or confirmation email. Unless we expressly state otherwise, acceptance of your order and formation of the sales contract occurs when we dispatch the goods to you. If we cannot accept your order, we will notify you and refund any payment taken for that order.

3. Pricing & Payments

All prices displayed on our website are in pounds sterling (GBP £) and include VAT where applicable.

We may update prices, product information and availability before an order is accepted. Changes will not affect an order after a contract has been formed, except where required by law or agreed with you.

Payment must be made using an approved payment method available at checkout. You are responsible for providing accurate billing and payment information.

4. Bespoke & Made-to-Order Products

Many Nest & Best products are made to order and may be manufactured according to the size, fabric, colour, storage option, finish, headboard design, mattress choice or other specifications selected by you.

Where goods are made to your specifications or are clearly personalised, statutory cancellation rights may not apply. This does not affect your rights if goods are faulty, not as described or otherwise fail to meet legal requirements.

Any additional return rights offered by Nest & Best, including our 60-day returns policy, are subject to the separate Returns & Refund Policy.

5. Delivery

Estimated production, dispatch and delivery information is provided on our website and in our Shipping Policy. Delivery estimates may vary depending on the product, selected specifications, material availability, delivery location and events outside our reasonable control.

Any additional delivery charge for eligible remote, offshore or other locations will be shown at checkout or otherwise agreed with you before the order is confirmed.

You are responsible for providing a correct delivery address and ensuring reasonable access for delivery. Please review our Shipping Policy for full delivery and access requirements.

6. Returns, Cancellations & Refunds

Our Returns & Refund Policy forms part of these Terms of Service.

Nest & Best offers eligible returns within 60 days of delivery, subject to the conditions set out in that policy. A £60 collection fee may apply to eligible change-of-mind returns as explained in the Returns & Refund Policy.

If an item is faulty, damaged, incorrect or not as described, your statutory rights apply and any remedy will be handled in accordance with applicable UK consumer law.

For made-to-specification or clearly personalised goods, cancellation rights may be restricted by law. If production has already begun, cancellation or amendment may also be limited in accordance with our Returns & Refund Policy.

7. Product Information

We aim to ensure that product descriptions, photographs, dimensions, colours and specifications are accurate and helpful.

Because products may be handmade and materials can vary, reasonable variations in colour, texture, stitching, dimensions, grain, pattern or finish may occur. Colours may also appear differently depending on lighting and device or screen settings.

Nothing in this section limits your rights where goods are materially different from their description or do not meet applicable legal standards.

8. Warranty

Selected Nest & Best products include a 5-year warranty against qualifying manufacturing defects in materials or workmanship under normal domestic use.

Warranty coverage, exclusions, remedies and claim procedures are set out in our separate Warranty Policy.

The warranty is provided in addition to, and does not replace or restrict, your statutory consumer rights.

9. Website Use

You must not misuse our website, attempt to gain unauthorised access to our systems, introduce malicious software, interfere with website operation, or use the website for unlawful or fraudulent purposes.

We may suspend access to the website where reasonably necessary for maintenance, security, legal compliance or to prevent misuse.

10. Liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so. In particular, nothing excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot lawfully be excluded or limited.

We are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill. We are not responsible for losses that were not reasonably foreseeable when the contract was formed.

We supply products for private domestic use unless otherwise agreed. If you use a product for commercial, business or resale purposes, different rights and limitations may apply.

Nothing in these Terms limits any remedy or right you have under applicable UK consumer law.

Unless otherwise stated, content on this website, including text, graphics, logos, branding, website design and product imagery, is owned by or licensed to NEST & BEST LTD and is protected by applicable intellectual property laws.

You may use the website for personal, non-commercial shopping purposes. You may not reproduce, distribute, modify, commercially exploit or use protected website content without permission, except where permitted by law.
